  • Is this a loan?

NO. We assume the risk that if there is no recovery from the pending lawsuit, you will not owe LH Funding anything. This is called a non-recourse funding. THIS IS NOT A LOAN. If you lose your case, you do not owe LH Funding anything.

  • Are there upfront fees?

NO. All payments to LH Funding are due at the time the case is settled. This includes the application fee.

  • What is the minimum or maximum funding amount?

THERE IS NONE. LH Funding reviews each case individually and will work with the client and the attorney to come to a mutual agreement as to the most sensible funding amount.

  • How long does it take to get the funds?

If approved, we can present a check within a day or two.

  • Do you have any say in the processing of the case?

NO. We have no control over the processing of your case and offer no opinion or advice. The case remains in the full authority and control of you and your attorney.

  • Does the funding violate usury laws?

NO. We take the risk of no recovery. If you don't recover money on the case, you do not owe LH funding anything. Therefore, the courts have continuously held that our funding is not a loan. This is called a non-recourse funding.

  • Is this legal?

Yes.

  • Is non-recourse funding costly?

Yes. This option for obtaining money is expensive.  LH Funding advises that if you have any alternative means to meet your immediate economic needs you should do so.  Additionally, it is best to request only the amount of money you need to meet your immediate economic needs as fees grow quickly the more money you obtain.   Please make sure you ask us any questions you have before accepting funds.

  • Can I change my mind after accepting funds?

Yes, you have five (5) business days to return the funded amount in full with no responsibility to you.  You will not owe any fees if you return all the money within the five business day period.

  • May an attorney refer a client to a funding company?

Yes.

  • May an attorney lend money to a client against their case?

No. That would be unethical. If you have more questions, please feel free to call us at 516.216.4353. You may also call our toll free number at 1.800.260.0419.
